Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the Cute Asian Things website, online store, and related services (collectively, the “Service”), and purchases you make through the Service.
The Service is doing business as Cute Asian Things (“Cute Asian Things,” “we,” “us,” or “our”). Our store is hosted by Shopify, which provides the ecommerce platform we use to offer our products.
By accessing the Service or placing an order, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the Service.
1. ELIGIBILITY AND ACCEPTABLE USE
You must be at least the age of majority where you live to make a purchase, or you must use the Service with the involvement and permission of a parent or legal guardian.
You may use the Service only for lawful, personal purposes. You must not:
• violate any applicable law or the rights of another person;
• submit false, fraudulent, or misleading information;
• interfere with the security or operation of the Service;
• introduce viruses, malicious code, or other harmful material;
• scrape, harvest, or collect information from the Service through automated means without our written permission; or
• copy, reproduce, sell, or commercially exploit any part of the Service without our written permission.
We may suspend or terminate access to the Service when reasonably necessary to protect the store, our customers, third parties, or comply with law.
2. PRODUCTS AND PRODUCT INFORMATION
We try to describe and display our products accurately. However, colors and appearance may vary depending on your device, display settings, lighting, or normal manufacturing differences. Product measurements are approximate unless stated otherwise.
Product availability is not guaranteed. We may change product descriptions, prices, or availability at any time before an order is accepted. We may also limit quantities or discontinue products.
Nothing in these Terms excludes any product warranty, guarantee, or other consumer right that cannot lawfully be excluded in your country or region.
3. ORDERS AND ACCEPTANCE
Your order is an offer to purchase. An order confirmation only acknowledges that we received your order; it does not necessarily mean that we accepted it. We accept an order when we begin processing or shipping it, unless applicable law provides otherwise.
We may reject or cancel an order for legitimate reasons, including product unavailability, pricing or listing errors, suspected fraud, payment problems, shipping restrictions, or suspected resale activity. If we cancel an order after payment has been collected, we will refund the amount paid for the canceled items and any related charges as required by law.
You are responsible for providing complete and accurate billing, shipping, and contact information. Please review your order carefully before submitting it and promptly contact us if you notice an error. We cannot guarantee that an order can be changed or canceled after processing begins.
4. PRICES, PAYMENT, AND CURRENCY
Prices are shown in the currency displayed at checkout. Applicable shipping charges, taxes, duties, and other charges will be disclosed at or before checkout when they are collected by us.
Your bank, card issuer, or payment provider may charge currency-conversion or international transaction fees. We do not control those fees.
You authorize us and our payment providers to charge the payment method submitted for your order. Payment information is processed by third-party payment providers under their own terms and privacy practices.
5. INTERNATIONAL ORDERS, TAXES, AND CUSTOMS
We may not ship to every country or region. Available destinations and shipping options are shown at checkout.
Unless checkout expressly states that import duties and taxes are included, an international order may be subject to customs duties, import taxes, brokerage charges, or other fees imposed by the destination country. The recipient is responsible for those charges. Customs procedures may delay delivery, and we do not control customs authorities.
You are responsible for ensuring that a product may lawfully be imported into and used in the destination country. We may cancel an order if we reasonably believe shipment would violate a law, carrier rule, trade restriction, or sanctions requirement.
6. SHIPPING AND DELIVERY
Shipping options and estimated delivery times are described at checkout and in our Shipping Policy. Delivery dates are estimates unless we expressly state otherwise. We are not responsible for delays caused by customs, carriers, severe weather, labor disruptions, incorrect addresses, or other events outside our reasonable control, but this does not limit any right you have under applicable law.
If we cannot ship within the time promised—or, for U.S. orders, within the period required by applicable law—we will provide any notice, cancellation option, consent request, or refund required by law.
Please inspect your delivery and contact us promptly about missing, damaged, or incorrect items at support@cuteasianthings.com. Your legal rights are not affected by a failure to report an issue within a voluntary reporting period stated in one of our policies.
7. RETURNS, REFUNDS, AND CANCELLATION RIGHTS
Returns, exchanges, refunds, order cancellations, and any final-sale exclusions are governed by our Return and Refund Policy, which is incorporated into these Terms.
Customers in some countries or regions—including certain consumers in the European Economic Area and United Kingdom—may have mandatory cancellation, withdrawal, return, warranty, or refund rights. Those rights apply even if our standard policy offers less protection. Nothing in these Terms or our Return and Refund Policy limits rights that cannot lawfully be waived.
8. PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes may be subject to separate conditions, expiration dates, product exclusions, minimum-purchase requirements, and limits on use. Unless stated otherwise, promotions cannot be combined, exchanged for cash, or applied to past purchases. We may cancel or correct a promotion affected by fraud, abuse, or an obvious error, subject to applicable law.
9. ACCOUNTS AND CUSTOMER CONTENT
If you create an account, you are responsible for keeping your login information confidential and for activity under your account. Notify us promptly if you believe your account has been used without permission.
If you submit a review, photo, comment, or other content (“Customer Content”), you retain ownership of it but grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute it in connection with operating and promoting Cute Asian Things. This license lasts only as long as reasonably necessary for those purposes, except where content has already been incorporated into materials that cannot reasonably be withdrawn.
You represent that you have the right to submit the Customer Content and that it is accurate and does not violate any law or third-party right. We may remove Customer Content that violates these Terms or is otherwise unlawful or inappropriate.
10. INTELLECTUAL PROPERTY
The Service and its original content—including text, graphics, logos, photographs, designs, and site arrangement—are owned by us or used with permission and are protected by applicable intellectual-property laws. No right or license is granted except the limited right to use the Service for its intended purpose.
11. THIRD-PARTY SERVICES AND LINKS
The Service may use or link to third-party services, including Shopify, payment processors, shipping carriers, social media platforms, and other websites. We do not control third-party websites or services and are not responsible for their content, availability, or practices. Your use of a third-party service may be governed by that provider’s terms and privacy policy.
12. PRIVACY
Our collection and use of personal information are described in our Privacy Policy. Shopify and other service providers may process personal information to provide the Service and complete transactions.
13. ERRORS AND CORRECTIONS
Occasionally, the Service may contain errors involving product descriptions, prices, promotions, shipping charges, delivery estimates, or availability. We may correct an obvious error and, when appropriate, cancel an affected order and issue a refund. We will not retroactively change an accepted order except where permitted by law.
14. DISCLAIMERS
To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, or error-free.
Any implied warranties or conditions that may lawfully be excluded are disclaimed to the fullest extent permitted by law. This section does not exclude any express product promise we make, any mandatory warranty, or any consumer protection that cannot lawfully be excluded.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Cute Asian Things and its owners, officers, employees, affiliates, agents, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses, or for loss of profits, revenue, data, or business opportunity, arising from use of the Service or a product purchased through it.
Where liability cannot be excluded, our total liability relating to the Service or a purchase will be limited to the greater of (a) the amount you paid for the product or order giving rise to the claim or (b) the minimum amount required by law.
These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer rights, or any other liability that cannot lawfully be limited or excluded.
16. INDEMNIFICATION
To the extent permitted by law, you agree to reimburse us for reasonable losses, liabilities, and costs arising from your unlawful use of the Service, your material breach of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from our own acts or omissions.
17. EVENTS OUTSIDE OUR CONTROL
We are not responsible for a failure or delay caused by events outside our reasonable control, including natural disasters, severe weather, war, civil unrest, epidemics, government action, labor disputes, carrier interruptions, power failures, or telecommunications outages. We will take reasonable steps to reduce the effect of the event and will provide any remedy required by law.
18. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
If you are a consumer, this section does not deprive you of mandatory protections under the laws of your place of residence or any right to bring a claim in another court when applicable law permits or requires it.
Before filing a claim, we encourage you to contact us at support@cuteasianthings.com so we can try to resolve the issue informally. This does not shorten or waive any legal deadline or right.
19. CHANGES TO THE SERVICE OR THESE TERMS
We may update the Service and these Terms from time to time. Changes apply prospectively from the date the revised Terms are posted, unless a different date is required by law. If a change is material, we will provide notice when required. The “Last updated” date above identifies the latest revision.
20. SEVERABILITY; NO WAIVER; ENTIRE AGREEMENT
If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. A delay or failure to enforce a provision is not a waiver.
These Terms and the policies incorporated into them form the entire agreement between you and us regarding the Service and purchases made through it, except for any additional terms expressly agreed to in writing.
